Purpose of the IoT Hub

The ThingsBoard IoT Hub ("IoT Hub") is a repository for digital assets, including but not limited to widgets, dashboards, templates, converters, and other configurations, as well as device integration guides and corresponding code (collectively, "Contributions"). The IoT Hub is intended to provide ThingsBoard platform users with free, open-access tools to enhance their IoT solutions and is a proprietary application of ThingsBoard, Inc.

Acceptance of Terms

By clicking "Publish," "Upload," or otherwise submitting a Contribution to The IoT Hub, you ("Contributor") agree to be bound by these Terms. If you are uploading on behalf of a company, you represent that you have the legal authority to bind that entity to these terms.

Licensing of Contributions

To ensure the IoT Hub remains free and open for all users, the following licensing terms apply: Public Grant: By submitting a Contribution, the Contributor hereby grants to every user of The IoT Hub and the ThingsBoard platform a worldwide, non-exclusive, perpetual, irrevocable, royalty-free, and sub-licensable license to use, copy, modify, merge, publish, distribute, and sell copies of the Contribution. The MIT License: All Contributions are officially licensed under the MIT License. This means users may use your code in both private and commercial projects without paying royalties, provided they include the original copyright notice in the code if applicable. No Commercial Claims: Contributor expressly waives any right to seek financial compensation, royalties, or licensing fees from any user who downloads or implements the Contribution.

Ownership and Intellectual Property

Retention of Authorship: The Contributor retains the copyright to their original work and may be credited as the "Author."

Non-Retraction: Once a Contribution is made available on The IoT Hub, the license granted is irrevocable. While a Contributor may remove their asset from The IoT Hub to prevent new downloads, they cannot revoke the rights of users who have already downloaded or implemented the asset.

Third-Party Rights: Contributor represents and warrants that the Contribution is their original work or that they have sufficient rights to license the material under the MIT License. Contributions must not infringe upon the patents, copyrights, or trademarks of any third party.

No Warranty and Limitation of Liability

"As-Is" Basis: ALL CONTRIBUTIONS ARE PROVIDED "AS IS", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.

Limitation of Liability: IN NO EVENT SHALL THINGSBOARD, INC. BE LIABLE FOR ANY CLAIM, DAMAGES, OR OTHER LIABILITY, WHETHER IN AN ACTION OF CONTRACT, TORT OR OTHERWISE, ARISING FROM, OUT OF OR IN CONNECTION WITH THE CONTRIBUTION OR THE USE OR OTHER DEALINGS IN THE CONTRIBUTION.

Administrative Rights

ThingsBoard, Inc. reserves the right, at its sole discretion, to:
    (a)Review, reject, or remove any Contribution that violates security standards, contains malicious code, or infringes on third-party rights.
    (b)Modify the categorization or metadata of a Contribution to improve the IoT Hub searchability.
    (c)Feature or promote specific Contributions to the community.

Governing Law

These terms shall be governed by and construed in accordance with the laws of the United States of America, New York State, without regard to its conflict of law provisions.
